Terms and Conditions for Application

Welcome to GiveEasy. This application is operated by GiveEasy Pty Ltd whose registered office is Suite Level 1, 20 Spring Street Bondi Junction NSW 2022 Australia.


GiveEasy Pty Ltd will be referred to as “we”, “our” and “us” in these Terms & Conditions. The term “you” refers to the user or viewer of our application (“the site”). By using this site, you agree to the Terms & Conditions of this application, which are set out on this page.


We reserve the right, at our discretion, to modify or remove portions of our Terms & Conditions at any time and such modification shall be effective immediately upon web posting of the modified terms and conditions. Your continued use of the GiveEasy Application shall be deemed to be your conclusive acceptance of the modified terms and conditions.

Changes to the site and services provided:

The content of the pages of this site is for your general information and use only. It is subject to change without notice;
GiveEasy will make every effort to ensure that the site and services are constantly operational;
GiveEasy reserves the right to modify, discontinue or suspend all or part of the site or its services at any time without notice.

User Conduct

You must not use the site in any way that causes, or is likely to cause, the site or access to it to be interrupted, damaged or impaired in any way;
In the event that you become aware of any content which breaches any of the above rules, please notify us immediately by emailing info@giveeasy.org;
You must not use the site to misrepresent your identity or affiliation with any person or organisation;
You must not use the site to send junk or spam email;
You must not use the site to conduct, display or forward details of any survey, contest, pyramid scheme or chain letter;
GiveEasy reserves the right to remove any content from any page without notice at its sole discretion;
You must not attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the site or any other web site;
You must not attempt to bypass the network firewall;
You must not use any part of the site which you are not authorised to use or devise ways to circumvent security in order to access part of the site which you are not authorised to access. This includes but is not limited to scanning networks with the intent to breach and/or evaluate security, whether or not the intrusion results in access;
You must not use or attempt to use the site for any unlawful, criminal or negligent purpose. This includes but is not limited to password cracking, social engineering (defrauding others into releasing their passwords), denial-of-service attacks, harmful and malicious destruction of data, and injection of computer viruses and intentional invasion of privacy.

Site Policy

Users must be 18 or older.

It is a condition of use of the site that no person under the age of 18 is to use this site to donate. People under the age of 18 can donate through a family member or guardian’s site with their direct supervision however must not operate their own account.

Charities and not for profit Organisation Members of GiveEasy (Recipient Organisations)

All the charities and not for profit organisations that appear on our site have entered into a contractual arrangement with GiveEasy which enables us to collect donations made on our site on their behalf. We cannot collect donations without their permission;
Some charities and not for profit organisations have similar names. It is your responsibility to ensure that the recipient organisation you have selected from the site is your intended recipient organisation;

Use of Funds by Recipient Organisations

GiveEasy makes no representations or warranties in relation to the appropriate use by recipient organisations of funds raised by use of the site or the services provided;
Recipient organisations make no representations or warranties in relation to the specific use of funds raised except in circumstances where the organisation has expressly stated that funds raised will be applied to a particular project or appeal.

Our Costs

The Donee will be charged a recoupment charge of between 2.9% and 5.5% (plus GST) of the gross amount of funds raised for the Donee for collections using Visa, Mastercard or Amex. This includes Macquarie Merchant Service fee of 0.95% (plus GST) and transactions fees from Stripe.

In the event GiveEasy adds additional payment mechanisms to the services in the future it will give prior notice to the Donee of the fees applicable to these.

Donations

All donations are in Australian Dollars and are not subject to GST.

Security Policy

GiveEasy is committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

We strive to ensure the security, integrity and privacy of personal information submitted to our sites, and we review and update our security measures in light of current technologies. Unfortunately, no data transmission over the Internet can be guaranteed to be totally secure.

However, we will endeavour to take all reasonable steps to protect the personal information you may transmit to us or from our online products and services. Once we do receive your transmission, we will also make our best efforts to ensure its security on our systems.

In addition, our employees and the contractors who provide services related to our information systems are obliged to respect the confidentiality of any personal information held by us. However, we will not be held responsible for events arising from unauthorised access to your personal information.

Links to other webpages

Our application/mobile application may contain links to enable you to visit other applications of interest easily. We review all the sites before providing a link to them to ensure that we do not provide links to any undesirable applications. However, these linked sites are not under our control and once you have used these links to leave our site, you should note that we do not have any control over that other application. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the application in question. We advise you to examine the terms and conditions of using that web site and its privacy statement. We do not make any representations about third party web sites that may be linked to our web site.

Refund Policy

Your decision to donate through GiveEasy is appreciated. As with any tax-deductible charitable contribution, any on-line contribution made to us cannot be cancelled or returned once it has been approved and completed.

GiveEasy collects donations on behalf of charities and passes the money direct to the charities. Of course, should an error be made by us, full refunds will be made immediately upon notification of the error and all costs be borne by us.

Credit Card Details

We utilise the Stripe Payment Gateway. The solution is safe and secure and provides enhanced security against online fraud. Credit card details are stored with Stripe after a transaction is made. If you would prefer for these to be removed after your donation has been securely made, please contact us at theteam@giveeasy.org

Unauthorised Card Use

You agree not to use an invalid or unauthorised credit card. Once a donation is made, the transaction is final and not subject to dispute unless unauthorised use of your payment card is proved. If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card issuer in accordance with its reporting rules.

Protecting your Password

Upon registration with GiveEasy, you will be invited to create a password to protect your personal account;
It is your responsibility to keep this password safe and ensure that it is not disclosed to any third party;
If you become aware that unauthorised use of your password has, or may take place, you are advised to change your password immediately by following the on-Site instructions;

Disclaimer and No Liability

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this application for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law;

Breach of Terms and Conditions of use

In the event of your failure to comply with these Terms and Conditions of use, we reserve the right to immediately suspend your access to any and/all parts of the site and the services provided there without notice and without reference to you.

Validity and Satisfaction of Terms

GiveEasy accepts no liability for any failure to comply with these terms and conditions where such failure is due to circumstances beyond the GiveEasy’s reasonable control;
If any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force.

Jurisdiction and Complaints

Your use of this application and any dispute arising out of such use of the application is subject to the laws of New South Wales, Australia;
Any complaint made about GiveEasy by either a member of the public or an employee must be referred in the first instance to GiveEasy. Such a complaint should be specific and in writing. Upon receipt of a complaint, GiveEasy will use its best endeavours to respond to the complaint and resolve any matters arising from it within 7 days. If, following a response from GiveEasy, the complaint is not resolved to your satisfaction, it may be referred for consideration by the appropriate state regulatory body.

Tax Deductibility

GiveEasy performs a service for charities and not for profit organisations. GiveEasy is not qualified to offer tax advice on the deductibility of donations made by a donor. However, all parties on whose behalf we collect donations for have represented to us that they have “Deductible Gift Recipient” status under Australian Tax Laws and have authorised us to issue receipts on their behalf on this basis.

Privacy Policy

Privacy relates to the collection and use of personal information you may supply to us through your conduct on the web site. We recognise the importance of protecting the privacy of information collected about visitors to our application, in particular information that is capable of identifying an individual (“personal information”). This Privacy Policy governs the manner in which your personal information, obtained through the application, will be dealt with and you should review it periodically so that you are updated on any changes. Personal Information

Personal information about visitors to our site is collected only when knowingly and voluntarily submitted. For example, we may need to collect such information to provide you with further services or to answer or forward any requests or enquiries. It is our intention that this policy will protect your personal information from being dealt with in any way that is inconsistent with applicable privacy laws in Australia.

By agreeing to the terms and conditions, you are also allowing the chosen charity which you are donating to, to contact you in the future. You can contact the charity directly should you wish to be taken off future communication.

Use of Information

Personal information that visitors submit to our site is used only for the purpose for which it is submitted or for such other secondary purposes that are related to the primary purpose, unless we disclose other uses in this Internet Privacy Policy or at the time of collection. Copies of correspondence sent from the web site, that may contain personal information, are stored as archives for record-keeping and back-up purposes only.

Disclosure

Apart from where you have consented or disclosure is necessary to achieve the purpose for which it was submitted, personal information may be disclosed in special situations where we have reason to believe that doing so is necessary to identify, contact or bring legal action against anyone damaging, injuring, or interfering (intentionally or unintentionally) with our rights or property, users, or anyone else who could be harmed by such activities.
